PropValues agrees to provide the registered subscriber access to the information system, referred to as PropValues, on the basis of a monthly subscription paid in arrears, subject on the following terms and conditions:

1. Registration
1.1	Completing the PropValues Subscription Form signifies acceptance of these terms and conditions without any modification. On completion of your registration these terms and conditions will form a binding legal agreement between the subscriber and PropValues.
1.2	The contract will commence on registration date and will run for a 12-month period, after which it will continue indefinitely until terminated by either party giving 30 days written notice.
1.3	The subscriber must ensure that all the details provided are true and correct. PropValues shall not be liable for any expenses, costs or damages incurred as a result of incorrect details.

2. Sales Data
2.1	The subscriber agrees to submit all conclusive sales to PropValues on or before the 7th day of each month.
2.2	The subscriber agrees to make every necessary effort to ensure that the sales data supplied is accurate.
2.3	Should the subscriber fail to submit their conclusive sales data on or before the 7th day of each month, PropValues reserves the right to suspend the subscriber’s access until all sales data has been submitted.

3. Software Licence Terms
3.1	The proprietary software and design concepts are owned by Prop Data (Pty) Ltd and are protected by copyright laws, both nationally and internationally. All rights are reserved.
3.2	PropValues grants to the subscriber a non-exclusive license to use its proprietary software and data.
3.3	The subscriber may not sell, copy, reproduce, re compile, or otherwise transfer the software and data to any third party, without written consent of PropValues.
3.4	The subscriber may not use the PropValues system to obtain any direct financial gain or for any other commercial purpose whatsoever.

4. Security
4.1	Any person that delivers or attempts to deliver any damaging code to this website or attempts to gain unauthorized access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that PropValues suffers any damage or loss.
4.2	The subscriber agrees and warrants that its login username and password shall: be used for personal use only; and not be disclosed to any third party.
4.3	The user allows PropValues to take all reasonable steps to ensure the integrity and security of the PropValues data and applications.

5. Disclaimer
5.1	Due to the nature of the application, no guarantee is given of uninterrupted or error free operation whether such is a result of network malfunction, coding errors, compiling errors or data loss.
5.2	Whilst reasonable care is taken to ensure that the information contained in PropValues is accurate, we cannot guarantee its accuracy and will in no way be held responsible for any liability or consequences arising from the use of information supplied on the system.

6. Debit Order
6.1	The monthly subscription fees will be paid by means of a monthly debit order against the subscriber’s banking account on the 7th day of each month.
6.2	The subscriber requests, instructs and authorizes Three Peaks / Debitsure (PropValues’ debit order facilitators) to draw against the subscriber’s bank account the amount necessary for payment. All such withdraws from the subscriber’s bank account by PropValues shall be treated as though they had been signed by the subscriber personally.
6.3	The R200 [ex vat] registration fee is a once off payment to be included in the first month’s debit order.
6.4	If the subscriber’s debit order is returned for whatever reason, PropValues will levy a charge of R50.00 + VAT per return of debit order.
6.5	The subscription fees are subject to an automatic annual increase of no less than 10% on the 1st day of March of every year. The subscriber hereby agrees that PropValues may automatically increase the monthly debit order amount accordingly.

7. Changes to Terms and Conditions
7.1	PropValues reserves the right to change these terms and conditions or any part thereof by giving 30 days written notice.
